8.Laytime and demurrage
Laytime will commence 6 hours after NOR has been tendered or immediately on berthing if earlier.
Demurrage will be payable on the basis of the Charter-Party rate applicable to the carrying vessel.If no demurrage rate is set out in the Charter-Party demurrage shall be calculated on the basis of an assessment by the London Tanker Broker Panel (LTBP) consistent with the carrying vessel performing this Contract..Both parties shall agree upon the amount of demurrage additionally.Costs of LTBP assessment to be borne by the Sellers.
In case of demurrage in the port of discharge the Buyers shall pay the Sellers the demurrage sum against appropriate documents.
Laytime and demurrage terms and conditions to apply as set out in part II of the standard ASBATANKVOY form of Charter-Party.
If the vessel arrives after agreed delivery date range,vessel to be berthed in proper turn with time counting from commencement of loading.
If the vessel arrives prior to agreed upon loading range,laytime shall commence from commencement of loading or at 6:00 am on the first day of the laycan whichever is earlier.
12.Force Majeure
Neither the Buyers nor the Sellers will be liable for damages or otherwise for any failure or delay in performance of any obligation hereunder other than any obligation to make payment,where such failure or delay is caused by force majeure,being any event or occurrence or circumstance reasonably beyond the control of that party,including but without prejudice to the generality of the foregoing,failure or delay caused by or resulting from acts of God,strikes,fires,floods,wars (whether declared or undeclared),riots,perils of the sea,embargoes,accidents,restrictions imposed be any government authority or person purporting to the act therefore (including allocations,priorities,requisitions,quotas and price controls),delays of the carrying vessel due to breakdown,adverse weather or sea conditions.The party whose performance is so affected shall notify the other party hereto indicating the nature of such cause and,to the extent possible,informs the other party of the expected duration of the force majeure event.
The time for the Sellers or the Buyers to perform their respective obligations under the Contract (other then the obligation to pay when due all amounts that are owing to the other which shall not be suspended) shall be extended during any period during which these obligations are prevented,hindered,curtailed or delayed by reason of any force majeure event up to a period of 30 consecutive days.If any of these obligations shall be prevented,hindered,curtailed or delayed for more than 30 days,either party may terminate this contract with respect to such delivery upon written notice to the other party.
