Scenario
Honest Harry,a second hand car dealer,displays a used Hillman Hurricane on his forecourt.It has a sticker in the windscreen stating “Excellent condition,one careful owner,£7,500”.
Dave Daft drives into the garage with his brother Dan.He tells Harry that he has been looking for just such a car for some time,particularly the model with the 2.0 litre engine.He asks Harry if the car is “a good economical runner”.Harry explains that he has not driven the vehicle himself,but that in his experience this model is very reliable and usually returns an average in excess of 40 mpg.
Dave is aware of a common fault with this make of car whereby the front wings rust and can fall off when cornering.Harry says he is aware of the problem and so has had the car checked.He hands Dave a report confirming that the wings on this car have been checked and are fine.Dave asks if his brother Dan,who is a qualified car mechanic,can check the bodywork anyway.Dan does so and confirms that everything is ok,and Dave tells Harry he will take the car.
In the office Harry hands Dave a bundle of documents,explaining that they contain the vehicle‟s log book,service history etc.He invites Dave to read them before buying the car,but Dave is in a hurry and declines.
Harry gives Dave a document and asks him to sign to confirm the sale agreement.Dave signs the document and hands it back to Harry,who asks Dave for £8,000 which he points out is the amount specified in the agreement he has signed.Dave has only brought £7,500 with him.Harry suggests he take the car anyway and bring the balance the following week.
A few days later Dave refills his petrol tank and notices that he has achieved only 20 mpg.He checks the other documents supplied by Harry and notes that the car is only a 1.6 litre model,half the scheduled services have been missed and Dave is in fact the fifth registered owner.On his way to the garage to confront Harry a front wing falls off the car as Dave takes a corner,causing him to crash into a tree,badly damaging an expensive clock on the back seat and injuring both of Dave‟s
legs.
Dave has written to Harry asking for his money back saying that he was misled into buying the car,and seeking damages for the clock and his injuries.He has received a response from Harry pointing out a clause in the agreement he signed which excludes liability for all damage,loss or injury howsoever caused.Harry is also seeking the outstanding £500.Dave considers this is unjustified on the basis that he believes that the agreed price was £7,500.
